Food to Power Waiver of Liability

This Release and Waiver of Liability releases liability for Food To Power, a nonprofit organization, and each of its directors, coordinators, advisors, and employees. The Participant is willingly participating in Food to Power volunteer activities and/or educational programming.

1. Waiver and Release: I, the Participant, release and forever discharge and hold harmless Food To Power and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my participation in Food to Power volunteer activities and educational programming. I understand and acknowledge that this Release discharges Food To Power from any liability or claim that I may have against Food To Power with respect to bodily injury, personal injury, illness, death, or property damage that may result from my participation in volunteer activities and/or educational programming.

2. Confidentiality: Further, I understand that organizational materials, lock codes, customer information must be kept confidential.

3. Insurance: I understand that Food To Power does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, disability benefits or insurance of any nature in the event of my injury, illness, death, or damage to my property. I expressly waive any such claim for compensation or liability on the part of Food To Power beyond what may be offered freely by Food To Power in the event of such injury or medical expenses incurred by me.

4. Medical Treatment: I hereby release and forever discharge Food To Power from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my participation in Food to Power volunteer activities and educational programming.

5. Assumption of Risk: I understand that my participation may include activities that may be hazardous to me including, but not limited to, lifting heavy items, working with tools and construction materials, exposure to food waste, raw land, and weather. As a Participant, I hereby expressly assume the risk of injury or harm from these activities and release Food To Power from all liability for injury, illness, death, or property damage resulting from my participation in volunteer activities and/or educational programming.

By selecting "Yes" below, I express my understanding and intent to enter into this Release and Waiver of Liability willingly and voluntarily.

Food to Power Media Release

I hereby grant permission to Food to Power, to use my image (photographs and/or video) for use in media publications including videos, email blasts, promotional brochures, newsletters, social media posts, website and/or affiliates or other uses.

I hereby waive any right to inspect or approve the finished photographs or electronic matter that may be used in conjunction with them now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of the image.

By selecting "Yes" below, I indicate that I am 18 years of age or older and I am competent to contract in my own name. I have read this release before selecting "Yes" below, and I fully understand the contents, meaning and impact of this release. I understand that I am free to address any specific questions regarding this release by submitting those questions in writing prior to signing, and I agree that my failure to do so will be interpreted as a free and knowledgeable acceptance of the terms of this release.

Food to Power’s mission is to cultivate a healthy, equitable food system in the greater Colorado Springs community. To be collaborators in building this world, we must build a culture of care and respect that is centered around our shared values. Please read this agreement carefully and behave in accordance with the values and safety measures below:

I agree to embrace Food to Power’s organizational values: Collaboration, Co-powerment, Communities, Equity, Resilience, and Innovation. We are in this together, and are here to uplift one another rather than approach others in the mindset of charity or superiority. I agree to approach other community members, volunteers, and staff in the spirit of respect, care, and dignity – meaning I will not say or do things that are racist, classist, homophobic, transphobic, or misogynistic, and I will be open to feedback on how my words and actions have affected others.*

I agree to treat the Hillside neighborhood and the Food to Power Hillside Hub space with respect. I will not litter, I will treat our neighbors with kindness, and I will do my part to leave the space how I found it.*

I agree to keep the Hillside Hub a Tobacco / Vape-Free space, both indoors and within 25 feet of any Food to Power building or structure (including the outdoor farm and garden spaces), in order to ensure the safety of our plants and people.*

I agree to keep the Hillside Hub a Firearm-Free space.*

I agree to uphold a harassment-free environment, this includes but is not limited to, not harassing volunteers, staff, or program participants on the grounds of sexual, gender identification, criminal history, citizen status or age.*

I agree to adhere to the following standards of safety:

Any participant under the age of 16 must be accompanied by an adult, unless exempted for specific educational programming.
All participants handling food must first wash and scrub hands with soap and water.
All participants handling food must wear plastic gloves while in contact with ready-to-eat foods.
Any participants who are experiencing sickness or illness should not participate in Food to Power volunteer events or educational programming.
Any participants transporting food as a volunteer activity for Food to Power must meet Time/Temperature Control for Safety standards: returning food to a temperature controlled environment within 2 hours and keeping food at least 6 inches from the floor at all times.
Any participants driving as a volunteer activity for Food to Power must obey car safety rules and traffic laws.
